Booking Terms and Conditions

1 GENERAL

1.1 BreakFree Holidays is the trading name of BreakFree Holidays Ltd. The company is registered in England with Registered Number 05753643 and the Registered Address is 54 Welbeck Street, London, W1G 9XS.

1.2 BreakFree Holidays acts as agent for the owner of the Park or Property (Park Owner/Operator) in booking the accommodation (Booking). The rental arrangements including, marketing, booking and administration services are made by BreakFree Holidays on behalf of the Park Owner/Operator and the contractual arrangement is directly between the Park Owner/Operator and you.

1.3 In the case of any inconsistency with any Booking or any other form of communication between you and the Park Owner/Operator, whatever may be their respective dates, the provisions of these Booking Conditions shall prevail unless expressly varied in writing and signed on behalf of BreakFree Holidays.

1.4 Any concession allowed by BreakFree Holidays to you shall not affect the rights of BreakFree Holidays. If in any particular case any of these Booking Conditions shall be held invalid or shall not apply to the Contract, the other Booking Conditions shall continue in full force and effect.

2 CONTRACT

2.1 The Contract for renting accommodation at the Selected Park or Property is between You and the Park Owner/Operator and it incorporates and is subject to these Booking Conditions

2.2 When you make a Booking you enter into a contract with the Owner for the letting of the Selected Park or Property in accordance with the Booking Conditions.

2.3 The Booking is accepted and the Contract comes into effect and will be legally binding when BreakFree Holidays issues an email confirmation to You. BreakFree Holidays reserves the right to decline any Booking at its discretion.

2.4 No verbal representation made by BreakFree Holidays shall be relied on by you.

2.5 No variation of these Booking Conditions shall be valid unless it is in writing and signed by or on behalf of BreakFree Holidays and you.

2.6 The contract between you and the Park Owner/Operator is subject to English law and the English courts shall have exclusive jurisdiction in relation to any matters arising out of these Booking Conditions or the Contract.

3 DURATION AND TIMES OF RENTAL

3.1 Holidays are either per week starting Friday, Saturday or Monday or per Short Break (Monday, 4 nights or Friday, 3 nights) (Holidays). Accommodation is usually available from 4pm on the arrival date and you must vacate the accommodation by 10am on the day of departure.

4 BOOKING

4.1 BreakFree Holidays are only available online. You may make a Booking by either:

  • completing our on-line booking form on the Website.
  • sending an email giving details of your Booking requirements to BreakFree Holidays at info@breakfreeholidays.co.uk

5 DEPOSIT AND PAYMENT

5.1 When you make a Booking, if the start date of your Holiday is more than 8 weeks away, a deposit of £25 per short break or £50 per week is payable (Deposit). The balance of the Holiday cost is payable 8 weeks before the start of the Holiday (the Due Date).

5.2 If the start date of your Holiday is less than 8 weeks away from the date on which you make the Booking, the full Holiday cost is payable.

5.3 Non payment of the final balance by the Due Date may be treated as cancellation. BreakFree Holidays will issue a Confirmation once You have completed the online booking process. (Confirmation).You should check the confirmation carefully and notify BreakFree Holidays immediately in case of any discrepancy or mistake. The Due Date will be set out on the Confirmation.

5.4 You may pay by credit card or debit card. No other form of payment will be accepted.

6 CHANGING A BOOKING

6.1 Once a Booking has been made, it can only be changed by treating the original Booking as a cancellation.

6.2 Holiday dates may be changed at the same Park, subject to availability, but an administration charge of £20 (+VAT) will be made

7 CANCELLATION

7.1 A Booking can only be cancelled before the start of the Holiday.

7.2 If you wish to cancel a confirmed Booking for any reason, You must notify BreakFree Holidays online and in writing.

7.3 If you cancel a Booking, a cancellation charge is payable depending on the number of days before the Holiday Start date we receive notice of your cancellation. The amount payable is as follows:

56 Days or more  - the Deposit

28- 55 days - 60% of the full holiday cost

14-27 days  -75% of the full holiday cost

0-13 days - 100% of the full holiday cost

7.4 We strongly recommend that Cancellation Insurance is taken out at the time of Booking. BreakFree Holidays do not currently offer Cancellation  Insurance.

8 YOUR OBLIGATIONS

8.1 You must be over 18 to book a BreakFree Holiday. The number of people staying in the Selected Park or Property must not exceed the maximum number stipulated on the Website for that type of accommodation.

8.2 We want all our customers to have an enjoyable holiday and you must be responsible for your actions and those in your party. You agree when on the Park or Property you will not be involved in any activity or behave in such a way as to cause a nuisance or annoyance to neighbours and other holidaymakers on the Park.

8.3 You and your guests will comply with any reasonable regulations relating to the Park or Property issued by local management.

8.4 You must take reasonable care of the accommodation and take precautions for your own safety.

8.5 You agree to keep the Park or Property and its contents in the same condition and repair as found on your arrival.

8.6 If either You, or any of your guests causes damage to the Park or Property and/or its contents, You agree to pay to BreakFree Holidays upon written demand, any reasonable costs incurred in making good any such loss or damage.

8.7 You must ensure that the Park or Property is left in a clean and tidy condition on your departure. BreakFree Holidays may charge you for the reasonable costs of any additional cleaning if this is considered necessary.

9 YOU AND YOUR PARTY

9.1 Only people whose names are on the holiday booking form (Booking Form) are permitted to occupy the Holiday Home provided. The person who completes the Booking Form confirms that:

- He or she is over 18 and has read and understood the Booking Conditions and is authorised to sign on behalf of all persons included on the Booking Form.

- He or she agrees to take responsibility for the Party occupying the accommodation

10 PETS

10.1 Dogs are welcome at some Parks at an extra charge.They must be kept under control. You should check the Park or Property details at the time of Booking so that BreakFree Holidays can confirm whether or not a dog will be permitted.

11 COMPLAINTS

11.1 If You have any cause for complaint during your stay in the Park or Property, You should notify BreakFree Holidays as soon as practicable and describe the nature of the complaint. BreakFree Holidays will use its reasonable endeavours to resolve any complaints on behalf of the Park Owner/Operator but, in accordance with condition 12.1, accepts no liability for its actions all of which are performed on behalf of the Park Owner/Operator who shall be solely liable.

11.2 Local Management should be contacted in the event that You have a problem with the Park or Property. They will use their reasonable endeavours to resolve any issues.

11.3 Any complaints You wish to make after your holiday has ended should be made in writing and sent to Breakfree Holidays within a reasonable period thereafter.

12 LIABILITY

12.1 BreakFree Holidays acts as agent on behalf of the Owner and is not liable to You or any of your party in any way whatsoever, including but not limited to any liability for any accident, damage, loss, injury, expense or inconvenience whether to person or property which You may suffer arising out of any acts or omissions by the Park Owner/Operator or howsoever arising. Furthermore, the Park Owner/Operator and BreakFree Holidays accept no liability for loss or damage to Your possessions on the Operator’s Property or land.

12.2 All warranties, conditions or other terms implied by statute or common law are to the fullest extent permitted by law, excluded from the Contract.

12.3 Nothing in these Booking Conditions excludes or limits the liability of the Park Owner/Operator or BreakFree Holidays for death or personal injury resulting from its negligence or for fraudulent misrepresentation or for any liability which cannot be excluded by law.

13 DATA PROTECTION

13.1 To process your Booking we need to collect certain information from you. We take full responsibility for ensuring the security of this information. For the purposes of the Data Protection Act 1998, the Owner/Operator and BreakFree Holidays are Joint Data Controllers of all personal data provided to BreakFree Holidays by You.

13.2 BreakFree Holidays will hold your personal data and may need to pass this data on to third parties and organisations who need to know them so that the Booking can be provided.

13.3 BreakFree Holidays would also like to store and use your personal data for future marketing purposes to send you for example, details of relevant promotions, or offers. All details, with the exception of credit/debit card data, given to BreakFree Holidays at any time will be kept, but only names, contact details and the Booking preferences will be used for marketing purposes. If you do not wish to hear from us by email, you can tick the opt-out box at the end of our on-line booking process.

14 EUROPEAN HOLIDAYS

For European Holidays there are these addtional terms and conditions:

14.1 Bookings for single sex parties are not permitted.

14.2 One member of each party must be 21 or over.

14.3 Customers are not permitted to take animals on to any of our parks.

14.4 Accommodation must be used within two days of the booking arrival date.  After this date Siblu reserve the right to re-sell the accommodation with no refund given.  Please advise the parc directly of any late arrival.

14.5 The accommodation together with furnishings, utensils and other contents must be kept in a reasonable condition and left in that state at the conclusion of the holiday All clients must either pay a deposit on arrival of €200. Wilful damage is not covered.

14.6 On arrival at parc €80 deposit will be taken for a cleaning deposit.  This is fully refundable on verification that your holiday home has been left in a clean and tidy condition.  If the party is departing early in the morning your deposit may not be refunded on departure, but will be returned within 28 days.
