Below are the terms and conditions for the Daily Mail holiday promotion. If you would like to view the terms and conditions for the Regional Newspaper promotion, click here. The newspaper terms and conditions supplement the Standard Booking Terms and Conditions and should be read in conjunction with them. Where they conflict, the promotional terms will apply. Daily Mail promotion terms and conditions

  1. CLOSING DATE: Bookings will close at midnight on Friday, 31 August 2018.
  2. AVAILABILITY: Holidays in this offer are subject to promotional availability at the time of your booking online or processing of your postal application. Not all locations will be available on all dates. Certain dates may be excluded from the promotion. BreakFree Holidays reserves the right to remove any accommodation on any date. This offer cannot be used in conjunction with any other offer.
  3. FINANCIAL PROTECTION: Daily Mail Trust and Holdings, publishers of the Daily Mail, do not own or operate any of the parks or resorts featured in this offer. Readers’ monies will be held in Trust by the booking agent, BreakFree Holidays, and will be passed to your holiday park or resort on completion of your holiday, thus offering financial protection.
  4. HOLIDAY CONTRACT: Holidays offered are organised by independent operators through the booking agent BreakFree Holidays. Your contract will be with the owner or operator of your holiday park and comes into effect when a holiday confirmation has been issued to you. Holiday confirmations will be issued immediately if you book online or within 14 working days if you book by post. If your postal application is unsuccessful we will contact you within 28 working days of receipt. For any queries please call the BreakFree Holidays/Mail Travel helpline on 0344 543 9700. Acceptance by BreakFree Holidays does not guarantee acceptance by the holiday park/company concerned if the party breaches their terms and conditions. The party with whom you have your holiday contract accepts liability only for the negligent acts and/or omissions of its employees.
  5. TERMS & CONDITIONS: These Terms and Conditions and How to Book apply to all holidays booked through this offer and, together with our Booking Terms and the standard conditions of the holiday park or resort operator, form the basis of your contract with your park or resort operator and theirs with you. Your application is your acceptance of the terms and conditions of this offer.
  6. HOLIDAY PAYMENT: Full payment for the holiday accommodation is required at the time of booking online (for postal booking please send £10 per person, minimum of £40, and any extra will be invoiced directly by your chosen park). Adults & children (infants) are charged at the same rate. Prices are per person per break. Where there are fewer than four people, the minimum charge for four people per break will be applied. Online payment must be made by credit or debit card and postal applications by cheque. Online bookings are subject to a £3 booking charge.
  7. SERVICE CHARGE: An additional service charge is applied by holiday parks to cover the cost of pre-arrival cleaning and preparation of your holiday home and gas and electricity. Charges are listed in full on the BreakFree Holidays website (on the relevant Park page) and are per unit per night. Service charges will be charged direct to you by your park in advance of your arrival. Some parks may also charge an additional refundable cleaning/damage waiver deposit. These charges are in addition to the cost of your accommodation. Failure to pay additional service charges may result in your holiday being cancelled.
  8. ENTERTAINMENT: Holiday Parks offer day and evening entertainment programmes for which there is a charge via Entertainment & Clubroom Passes but this is optional and customers do not have to participate. Optional charges for entertainment are listed in full on the BreakFree Holidays website (on the relevant Park page). Please note that Entertainment/Clubroom passes may be required for access to facilities such as swimming pools, bars, restaurants etc. on selected parks. Some facilities may be seasonal and therefore not open during your holiday. The entertainment pass does not cover extra-charge activities such as fishing, sports coaching, rock climbing, etc. If in doubt, please contact the park for details.
  9. HOLIDAY PARTIES: These are family holidays and bookings cannot be accepted from parties where all people are under the age of 25. Only people whose names are on your holiday booking form are permitted to occupy the holiday home allocated.
  10. NO AMENDMENTS can be made by you after your holiday application has been confirmed online or your application received by post. No refunds can be made in the event of cancellation by you after the holiday confirmation has been issued to you in accordance with your application, unless the reason for cancellation is default by the park operator.
  11. HOLIDAY HOMES: 2018 dates, holiday accommodation prices: Comfort mobile homes start from £10 per person per break, Comfort Plus mobile homes start from £15 per person per break, Comfort Extra Wide mobile homes start from £20.50 per person per break, Premier Plus mobile homes start from £33.50 per person per break, depending on date selected. Holiday homes will be available from 4pm on day of arrival and must be vacated by 10am on day of departure. Accommodation will be allocated by the holiday park/resort based on the size of the party. If arriving at your park during late evening you MUST advise your park/resort direct in advance. Larger groups may be asked to pay a damage waiver deposit by the operator/park.
  12. ADAPTED ACCESS CARAVANS: These are available on most parks to suit people with disabilities. Please call us BEFORE you book, to discuss your individual requirements on 0800 138 3241.
  13. HOLIDAY DURATIONS: Three-night weekend breaks start on Friday and end on Monday. Four-night midweek breaks start on Monday and end on Friday. All holidays are subject to a minimum duration of three nights.
  14. BREAKAGES: It is your responsibility to leave your holiday home in the condition that you found it. Breakages, damaged or missing items WILL be charged to you.
  15. SELF-CATERING: These are self-catering holidays.
  16. BED LINEN & EXTRAS: Bed Linen is included ONLY with Premier Plus accommodation. For all other unit types, you may bring your own linen or hire it direct from the park at a supplement. An additional charge for any extras required, e.g. cots or highchairs, will be made by the park and is payable directly to them.
  17. PETS: Dogs are only permitted at parks that display the dogs permitted symbol in the park listings. A maximum of two small/medium sized dogs will be permitted in dog-friendly holiday homes at these parks. Other pets and some breeds of dog, including those listed in the Dangerous Dog Act, are not allowed. If you are unsure whether or not your dog is allowed, please check with your park directly prior to booking. A charge is made for each dog and this must be paid at the time of booking. Dogs are not allowed on bedding or seating, must not be left unattended, must be kept on a lead at all times, and you must clean up after your dog. Dogs (other than assistance dogs) are not allowed in any park facilities or play areas. If your dog is causing a nuisance or damage, parks reserve the right to require you to remove it from the park.
  18. ASSISTANCE DOGS: Registered assistance dogs for disabled guests are exempt from pet charges and are allowed in any accommodation at any park. If you are travelling with a registered assistance dog, please make your booking and then call our team on 0344 84 84 534 to tell us that an assistance dog has been included.
  19. INSURANCE: Insurance is not included and is £12 per booking for UK Personal Insurance if required, when booking online. Insurance cannot be booked with postal applications. Full details of the insurance can be found on the website or will be sent to you by contacting enquiries@breakfreeholidays.co.uk.
  20. FREE FOOD & DRINK VOUCHER: Available on selected midweek breaks and parks where advertised - entertainment passes must be purchased to receive them. Excludes school holidays and Bank Holidays.
  21. DATA PROTECTION: For the purposes of the General Data Protection Regulation (GDPR), BreakFree Holidays and DMGT Media are Joint Data Controllers of all personal data provided. By opting in to receiving marketing emails we will send you regular updates of the latest news on the promotion you took part in and also any other offers from the holiday provider, BreakFree Holidays. BreakFree Holidays will only share your details with third parties where it is necessary to administer, process and confirm your holiday booking. Those third parties may then contact you directly to further administer, process and confirm your holiday booking.

BreakFree Holidays: General Terms & Conditions

These are the standard terms and conditions for booking a holiday with BreakFree Holidays.

1. GENERAL

1.1. BreakFree Holidays is the trading name of BreakFree Holidays Ltd. The company is registered in England with Registered Number 05753643 and the Registered Address is IMEX, 575-599, Maxted Road, Hemel Hempstead, Herts, HP2 7DX (We, Us).

1.2. BreakFree Holidays acts as agent for the owner of the Park or Property (Park Owner/Operator) in booking holiday rental accommodation for you (your Booking). The rental arrangements, including marketing, booking and administration services are made by Us on behalf of the Park Owner/Operator.

2. CONTRACT

2.1. The contract for renting accommodation at the selected park on the selected dates (Holiday) is between You and the Park Owner/Operator and it incorporates and is subject to these Booking Conditions and those of the Park Owner/Operator.

2.2. Once You have completed the online booking process, We will issue a booking confirmation to you via email (Confirmation). At this point the Contract comes into effect and will be legally binding. You should check this acknowledgement carefully and notify Us immediately in case of any discrepancy or mistake. We and the Park Owner/Operator reserve the right to decline any Booking at our discretion.

3. BOOKING

3.1. BreakFree Holidays are available to book online.

3.2. Adapted access accommodation is available on most parks to suit people with disabilities. Please call Us on 0800 138 3241 before you book to discuss your individual requirements.

3.3. For help contact Us by telephone on 0344 84 84 534. We believe that you should be treated with courtesy and respect by BreakFree Holidays and its staff. We also believe our staff have the same rights and we expect you to treat them with courtesy and respect too. Unreasonable behaviour is behaviour or language (whether verbal or written) that may cause staff to feel intimidated, threatened or abused. We therefore reserve the right to decline any Booking.

4. DEPOSIT AND PAYMENT

4.1. When you make a Booking, if the start date of your Holiday is more than 10 weeks away, a non-refundable deposit of £25 per short break or £50 per week is payable (Deposit). The balance of the Holiday cost is payable 10 weeks before the start of the Holiday (the Due Date).

4.2. The Due Date will be set out in the Confirmation. Non-payment of the final balance by the Due Date may be treated as a cancellation (see Cancellation below).

4.3. If the start date of your Holiday is less than 10 weeks away from the date on which you make the Booking, the full Holiday cost is payable immediately.

4.4. A £3.00 online Booking Fee applies to holiday bookings.

4.5. You may pay by credit card or debit card or use your Paypal account. Payment by cheque is only accepted for postal applications on newspaper promotions.

4.6. VAT is charged at the applicable rate at the time of booking and is included in the price of your Holiday. You agree we may increase or decrease the price to reflect a change in the VAT rate.

5. DURATION AND TIMES OF RENTAL

5.1. Holidays are either per week (7 nights) starting Friday, Saturday or Monday or per Short Break (Monday, 4 nights or Friday, 3 nights, or Friday/Saturday for a 2-night break). Accommodation is usually available from 4pm on the arrival date and you must vacate the accommodation by 10am on the day of departure.

6. CHANGING A BOOKING

6.1. Once a Booking has been made, it can only be changed by treating the Booking as a cancellation or as set out in clause 6.2 below.

6.2. Exceptionally, holiday dates may be changed at the same Park, subject to availability and Operator agreement, but an administration charge of £20 (+VAT) will be made.

6.3. Where we have made an obvious error (such as incorrect pricing) we will immediately contact you and you can either agree to amend the Booking and pay any additional charges necessary, or you can cancel your booking without charge and we will refund any money you have paid.

7. CANCELLATION

7.1. If you wish to cancel a confirmed Booking for any reason, You must notify BreakFree Holidays at enquiries@breakfreeholidays.co.uk as soon as possible.

7.2. If you cancel a Booking, a cancellation charge is payable depending on the number of days before the Holiday Start date we receive notice of your cancellation (Cancellation Charge). The Cancellation Charge is calculated as follows:

  • 70 Days or more - the Deposit
  • 28-70 Days - 60% of the full holiday cost
  • 14-27 Days - 90% of the full holiday cost
  • 0-13 Days - 100% of the full holiday cost

7.3. We may have to cancel a Booking due to the unavailability of key personnel or key facilities without which the Holiday cannot be provided to You. If this happens:

  • 7.3.1. we will promptly contact you to let you know
  • 7.3.2. we may cancel your Booking and refund your payments, or offer an alternative Holiday (which You may need to pay more for or we will refund the difference if the holiday cost is less than the original holiday price)
  • 7.3.3. if we offer an alternative Holiday you may still choose to cancel your Booking and we will refund the payments you have made to us.

7.4. We may cancel the Booking at any time with immediate effect if:

  • 7.4.1. you do not pay us when you are supposed to, or
  • 7.4.2. you are in breach of these Booking Conditions in any other material way and you do not remedy the situation within a reasonable period after we ask you to.

7.5. We strongly recommend that You consider purchasing cancellation insurance to cover your Holiday.

8. YOUR OBLIGATIONS

8.1. You must be over 18 to book a BreakFree Holiday. The number of people staying in the selected accommodation set out in the Park Owner/Operator’s Acceptance (the Accommodation) must not exceed the maximum number stipulated on Our website for that type of accommodation.

8.2. We want all our customers to have an enjoyable holiday and you must be responsible for your actions and those in your party. You agree when on the Park you will not be involved in any activity or behave in such a way as to cause a nuisance or annoyance to neighbours and other holidaymakers on the Park.

8.3. You and your party members will comply with any reasonable regulations relating to the Park or Property issued by local Park management.

8.4. You must take reasonable care of the Accommodation and take precautions for your own safety.

8.5. If either You, or any of Your party members causes damage to the Park or Accommodation and/or its contents, You agree to pay upon written demand, any reasonable costs incurred in making good any such loss or damage.

8.6. On departure, You must ensure that the Accommodation is left in the same condition and repair as found on your arrival. You may be charged for the reasonable costs of any additional cleaning if this is considered necessary.

9. YOU AND YOUR PARTY

9.1. Holidays booked via BreakFree Holidays are subject to the terms and conditions of the Park Owner/Operator.

9.2. All holidays booked via BreakFree Holidays are family holidays. As a result, some Park Owner/Operators do not accept large group bookings under the age of 25. Please ask us for more information.

10. PETS

10.1. Dogs are welcome at some Parks at an extra charge. They must be kept under control. You should check the Park or Property details at the time of making the Booking as operators reserve the right to refuse entry to any dog that is considered a dangerous dog breed. This may vary by Park/Operator.

11. COMPLAINTS

11.1. If You have any cause for complaint during your stay in the Park or Property, You should notify the local Park management during your stay on the Park/Property. They will use their reasonable endeavours to resolve any issues.

11.2. If your complaint persists and the local Park management is unable to resolve your complaint, please contact Us as soon as practicable and describe the nature of the complaint. We will use Our reasonable endeavours to resolve any complaints.

11.3. Any complaints You wish to make after your holiday has ended should be made in writing and sent to BreakFree Holidays within 7 days of completing your holiday. Please provide Us with as much detail as possible so that we may attempt to resolve the matter.

12. LIABILITY

12.1. We act as agent on behalf of the Park Owner/Operator and are not liable to You or any of your party in any way whatsoever, including but not limited to any liability for any accident, damage, loss, injury, expense or inconvenience whether to person or property which You may suffer arising out of any acts or omissions by the Park Owner/Operator or howsoever arising. Furthermore, the Park Owner/Operator and BreakFree Holidays accept no liability for loss or damage to Your possessions on the Operator’s Property or land.

12.2. All warranties, conditions or other terms implied by statute or common law are to the fullest extent permitted by law, excluded from the contract.

12.3. BreakFree Holidays and the Park Owner/Operator limits its liability in respect of your Booking and any alleged breach of contract, or claim at common law or otherwise, to the total cost of your Holiday.

12.4. Nothing in these Booking Conditions excludes or limits the liability of the Park Owner/Operator or BreakFree Holidays for death or personal injury resulting from its negligence or for fraudulent misrepresentation or for any liability which cannot be excluded by law.

12.5. We and the Park Owner/Operator will not be liable for any events outside of our reasonable control including, but not limited to strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks.

13. DATA PROTECTION

13.1. To process your Booking we need to collect certain information from you. We take full responsibility for ensuring the security of this information. For the purposes of the General Data Protection Regulation 2018, the Owner/Operator and BreakFree Holidays are Joint Data Controllers of all personal data provided to Us by You.

13.2. We will hold your personal data and may need to pass this data on to third parties and organisations who need to know them so that the Booking can be provided.

13.3. We will store and process your personal data for future marketing purposes to send you for example, details of relevant promotions, or offers. All details, with the exception of credit/debit card data, given to Us at any time will be kept but only names, contact details and the Booking preferences will be used for marketing purposes. If you do not wish to hear from us by email in future, you can unsubscribe at the end of any marketing email or alternatively please contact us via email or phone to arrange this. Please note: if you do unsubscribe from promotional email newsletters, you will still receive essential email communications specifically relating to your account or any booking you have with us.

14. SOCIAL MEDIA

14.1. Our social media pages, (Facebook, Twitter and others), are open to comments from all of our customers and we welcome your feedback, pictures and videos.

14.2. We will remove, without notification, any posts or comments that we deem to be inaccurate, offensive or inappropriate – this can include comments posted en masse, comments that are not relevant to the post, use of profanities, personal insults and text entirely in capitals.

14.3. If we receive a complaint through our monitored social media channels, we will handle the complaint through our standard procedure and will contact you directly to progress further. For your privacy, we will never comment on individual bookings through a public forum.

15. EUROPEAN HOLIDAYS

For Holidays in Europe these additional terms and conditions apply:

15.1. One member of each party must be 21 or over.

15.2. Dogs are welcome at some Parks at an extra charge. You will need to contact the Operator before booking to check whether your dog will be accepted. Park / campsite owners reserve the right to refuse entry to any dog that is considered dangerous, even a cross-breed of a dangerous dog. If you are unsure that your dog may or may not be accepted onto a Park, We recommend that you do not consider this type of holiday with your dog. We cannot be held liable for a dog being refused entry onto a park.

15.3. The accommodation together with furnishings, utensils and other contents must be kept in a reasonable condition and left in that state at the conclusion of the holiday. All customers must pay a deposit on arrival of €200, or pay a non-refundable equipment damage waiver at time of booking. Wilful damage is not covered.

16.1. You should assume that everything you see or read on the website is protected by copyright unless otherwise stated and may only be used with Our prior written permission. Images are either the property of, or used with permission by, BreakFree Holidays Ltd.

17. TRADEMARKS AND LOGOS

17.1. The trademarks and logos displayed on the website are trademarks of BreakFree Holidays Ltd. Nothing contained on the website should be construed as granting any license or right to use any trademark displayed on the website without the prior written permission of BreakFree Holidays Ltd or a third party owning a trademark displayed on the website.

18. OTHER IMPORTANT TERMS

18.1. You agree that you have not relied on any verbal representation when making Your Booking.

18.2. No variation of these Booking Conditions shall be valid unless it is in writing and signed by or on behalf of Us and you.

18.3. The contract between You and the Park Owner/Operator is subject to English law and the English courts shall have exclusive jurisdiction in relation to any matters arising out of these Booking Conditions or the Booking.

18.4. In the case of any inconsistency with any Booking or any other form of communication between you and the Park Owner/Operator, the provisions of these Booking Conditions shall prevail unless expressly varied in writing and signed on behalf of BreakFree Holidays.

18.5. Any concession in these terms allowed by Us to you shall not affect the rights of BreakFree Holidays to enforce them at a later date. If in any particular case any of these Booking Conditions shall be held invalid or shall not apply to the Contract, the other Booking Conditions shall continue in full force and effect.
